Intellectual Property are the intangible assets of a business and are in the form of innovations, inventions, ideas & creations of the human mind– a result of the application of the intellect.
The laws which safeguard such original ideas are called Intellectual Property Rights (“IPR”), which gives the creator an exclusive right over the use of his / her own original creations for a certain period of time, to the exclusion of others. IPR allows intellectual property owners alone to benefit from their inventions during this period.
The owner of an IPR may – while exercising his/her right – prevent the manufacture, use or sale of a product / service which incorporates his / her IPR and can take legal action in case of any imitation.
Trademark
A trademark, popularly known as a brand name, is a unique symbol, logo or word(s) used to represent a business or its products / services. It enables the consuming public to distinguish the goods / services of one trader from another.
Copyright
A Copyright is a set of rights given under the Copyright Statute to the creators of artistic, literary, musical, dramatic, sound recording and cinematography films. A Copyright does not protect concepts, ideas, discoveries, procedures and methods.
Patent
A Patent is a statutory right for an invention granted for a limited period of time to the patentee by the Government, in exchange of full disclosure of his invention for excluding others, from making, using, selling, importing the patented product or process for producing that product for those purposes without his consent.
Industrial Design
An industrial design means features of shapes, configuration, pattern or ornament, whether in two dimensional or three dimensional applied or both forms, applied to an article by any industrial process or means which in the finished article appealed to and is judged by the eye.
